1. Agreement to these terms
Welcome to the PT Watercraft Shop, operated by Port Townsend Watercraft in Port Townsend, Washington ("we", "us", "our"). By browsing this site or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the shop.
2. Our products
We design boat kits, and sell parts for small boats, instructional books, and other merchandise — some delivered as physical goods, some as digital downloads. We work hard to describe everything accurately, but we do not guarantee that descriptions, photos, pricing, or availability are error-free. Colors and materials may vary slightly from photos. If we discover an error affecting your order (including a pricing error), we will contact you and offer to confirm at the correct terms or cancel for a full refund.
3. Orders and payment
Payment is processed securely by Stripe at checkout. Your order is an offer to purchase; it is accepted when we send your order confirmation email. We may refuse or cancel any order — for example, when an item is out of stock, a listing contains an error, or we suspect fraud — and if we do, you will receive a refund of any amount paid. Applicable sales tax is calculated at checkout. All prices are in US dollars.
4. Shipping
We ship physical goods to the United States. Shipping costs are shown at checkout. If your order arrives damaged or goes missing in transit, contact us at info@ptwatercraft.com and we will work with you and the carrier to make it right.
5. Returns and refunds
If you're not happy with a physical product, contact us within 30 days of delivery. Returned items must be unused and in their original condition and packaging. Once we receive and inspect the return, we will refund the purchase price to your original payment method. Return shipping is at your expense unless we sent the wrong or a defective item. Parts that have been partially assembled, cut, glued, or coated cannot be returned.
6. Digital products
Digital products (such as instructional e-books) are delivered by email as download links after purchase. Download links expire after a period of time — if your link has expired or you have trouble downloading, contact us and we will help. Your purchase gives you a personal, non-transferable license to use the digital product for your own projects. You may not resell, republish, or redistribute it. Because digital products cannot be returned, all sales of digital products are final once the product has been delivered — but if something is wrong with your download, contact us and we will make it right.
7. Boat building — safety and responsibility
Our kits, parts, and instructions are materials and guidance for projects that you build and use. You are responsible for the quality of your construction, for following the instructions, and for the safe use of anything you build. Boating and boat building carry inherent risks. Always use appropriate safety equipment, follow applicable boating laws, and honestly assess conditions and your own abilities. We do not warrant the seaworthiness, safety, or fitness of any finished boat or modification built from our products, as construction quality and use are outside our control.
8. Intellectual property
All content on this site and in our products — including designs, plans, instructions, text, and photographs — belongs to Port Townsend Watercraft or its licensors and is protected by copyright. Purchasing a kit or book gives you the right to build and use the product for personal use; it does not transfer any rights to the underlying designs or content.
9. Acceptable use
You agree not to misuse this site — including placing fraudulent orders, attempting to interfere with the site's operation, or accessing it by automated means for scraping or resale purposes.
10. Disclaimers and limitation of liability
Except as expressly stated in these terms, our products and this site are provided "as is," and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law. To the fullest extent permitted by law, our total liability for any claim arising out of a purchase is limited to the amount you paid for the product in question, and we are not liable for indirect, incidental, or consequential damages. Some jurisdictions do not allow certain warranty exclusions or liability limits, so parts of this section may not apply to you.
11. Governing law
These terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Washington.
12. Changes to these terms
We may update these terms from time to time. The version posted on this page at the time you place your order applies to that order.
